BenQ Gaming Bash (the “Event”) is an online event organized by BenQ America Corp. (“BenQ”). BenQ will sponsor influencers to join the BenQ Squad and participate in a Call of Duty: Warzone competition, namely the Realism Battle Royale mode. Non-BenQ Squad participants will then compete against the BenQ Squad based on the rules of this chosen mode. Winners will be eligible for prizes under the terms and conditions below.
Terms and Conditions
By entering this Event, Participants agree to be bound by these Terms and Conditions.
Definitions
“Promoter” is BenQ America, whose registered office is at 3200 Park Center Drive, Suite 150, Costa Mesa, CA 92626, U.S.A.
“Event” is the online match organized by the Promoter within the environment of Call of Duty: Warzone Realism Battle Royale mode (aka BenQ Gaming Bash) subject to the terms and conditions herein.
“Participant” is any player account that enters the Event, whether or not the player stays through the end of each match or Event.
“BenQ Squad” is a team formed by four BenQ influencers that will interact with Participants in the Event.
How to Join
There is no entry fee and no purchase of the Promoter’s product required to enter this event.
This is a regional event, and is open to anyone who plays Call of Duty: Warzone on the North America server and has his/her official residence in the United States or Canada. To enter the Event, the Participant must select the applicable Call of Duty: Warzone server and have a valid Activision account with an individual username. It is the Participant’s responsibility ensure that their accounts are valid and eligible for joining the Event.
Individuals between the ages of 14 and 18 must have permission from a parent or legal guardian, who must read these Terms and Conditions and agree to be bound by them, on behalf of their minor child. Failure to secure such consent will invalidate that person’s entry and forfeit any prize. The Promoter reserves the right to confirm that such permission has been granted and withhold any participation or prize award until it satisfied that a parent or legal guardian has read these Terms and Conditions and agrees to allow their minor child to participate. Notwithstanding the foregoing, the responsibility to secure and evidence consent is on the Participant and/or parents.
The Event
The Event will take place on 13th August, 2020 consisting of two matches: the first match will start at 10:00 pm (EST) and the second match at 10:50 pm (EST). The BenQ Squad will join a queue to enter the server, where they will be matched with up to 147 other Participants. Therefore, the Promoter cannot promise that each Participant will be able to meet the BenQ Squad in each match. Activision controls all matchmaking for Call of Duty: Warzone, and the Promoter cannot exercise any discretion or control in this regard.
Prizes
The winning Participants will receive one (1) BenQ EX2710 144Hz gaming monitor each. The Promoter will award up to four (4) monitors per match depending on the number of people who survive the battle royale mode. If the BenQ Squad remains intact until the end of the match and wins, no monitor will be gifted to any Participants. The Promoter reserves the right to substitute the monitor model for one of equal or better specs.
The monitors given as prizes are non-exchangeable and not redeemable for cash, credit or any other items or service. Winners are responsible for any tax resulting from their receipt of a prize.
Winners Announcement
The winning Participants must take a screenshot as proof of their win and forward it to the following BenQ email and social media accounts through direct message:

The Promoter will verify the claim with footage captured from the BenQ Squad, and cross check against publicly-visible Activision server data. The Promoter will announce the winner(s) within seven (7) days from the end of the Event on BenQ North America social media accounts. Evidence submitted by winning parties will be posted. The All winning claims will be subject to the Promoter examination and confirmation and make the final determination regarding winner(s).
Prize Delivery
Together with the screenshot the winning Participants must also provide their contact information and shipping address for the delivery of the Price to a valid address in the 50 United States or Canada.
As the event is only open to Participants living in the United States and Canada, the Promoter will not ship prizes to addresses outside those two territories. The Promoter, however, may consider exceptions on a case by case basis, for example residents of the United States or Canada living temporarily overseas, U.S. military personnel stationed elsewhere in the world, and so forth. The Promoter makes no promise to ship prizes outside the United States and Canada, but will be open to petitions on a case by case basis if need be at its discretion.
If the Promoter does not receive the contact and shipping information from any winner within fourteen (14) days after the winner announcement, that winner’s qualification will be cancelled and the prize forfeited without compensation of any kind.
Social Media Posts
Winners are encouraged to post unboxing pictures or videos of the monitors on their social media accounts after receiving the monitors
Prohibited Conduct and Cancellation of Qualification
The Promoter reserves the right to restrict or cancel any entry to the Event and/or the eligibility for receiving a prize, without any prior notice if in the Promoter’s opinion and sole discretion, a Participant carries out any actual or anticipated breach of any applicable law or regulation, or otherwise violates any of these terms and conditions, or commits or is suspected fraud or misrepresentation.
Disclaimers
The Promoter does not and will not guarantee that the gaming environment is reliable, error-free, uninterrupted, free of viruses or other harmful components, or that the experience related to the Event will meet the expectations of all Participants. The Promoter will not be liable for the lack of accuracy, completeness, and security of any data input or output, content or services not offered by the Promoter, or any loss or damage to the Participant’s (or any other person’s) account, devices, data, or virtual properties related to or resulting from the Event, including but not limited to downloading any materials, postal failure, equipment failure, and technical malfunction of systems, satellites, networks, internet connectivity, servers, computer hardware, or software. Participants are responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for anti-virus protection and accuracy of data, and reconstruction of lost data. The Promoter assumes no responsibility of, and will not be held liable for, any conduct or statement by any Participant.
PARTICIPANTS HEREIN AGREE THAT IN NO EVENT OR CIRCUMSTANCES WILL THE PROMOTER, ITS AFFILIATES, OR THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS, OR BENQ INFLUENCERS (COLLECTIVELY THE “BENQ PARTIES”), BE LIABLE FOR CLAIMS AND/OR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, CAUSE OF ACTION OR NEGLIGENCE, ARISING OUT OF OR IN CONNECTION WITH THE PARTICIPATION OF, OR INABILITY TO PARTICIPATE IN, THE EVENT, AT ANY TIME AND FOR ANY PERIOD, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGE TO PROPERTY, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER BASED ON TORT, NEGLIGENCE, BREACH OF CONTRACT, OR OTHERWISE, EVEN IF THE BENQ PARTIES MAY HAVE BEEN ADVISED ACCORDINGLY.
Change to Terms and Event
The Promoter reserves the right to, at any time, revise or update these Terms and Conditions, and to modify or discontinue, temporarily or permanently, the Event with or without reason, including due to any human error, technical failure, or force majeure. Any change to the Terms and Conditions or the Event will be published on the Promoter’s websites and/or social media accounts. Continued participation following such changes means the acceptance to such changes.
Handling of Personal Information/ Privacy
Each Participant agrees that any personal information provided by them shall be: (a) processed in accordance with BenQ Privacy Policy, which is available at https://www.benq.com/en-us/policy/privacy-policy.html; and (b) used by Promoter and their respective agents and suppliers to administer the Competition and to enable Promoter to promote the Competition in any media.
Our Privacy Policy describes our practices concerning data that you provide or that we may collect about you arising out of or in relation to the Event, and you consent to our use and disclosure of such data in compliance with the Privacy Policy. When you accept any prize in connection with the Event, you will execute a release which will constitute your consent for the disclosure of personal information for the promotional purposes.
Entire Agreement
These Terms and Conditions and BenQ Privacy Policy constitute the sole and entire agreement between the Participant and the Promoter regarding the Event, and supersede all prior and contemporaneous, written and oral, understandings, agreements, representations, and warranties.
Waiver
No waiver by the Promoter of any term or condition set out in these Terms and Conditions will be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Promoter to assert a right or provision hereunder will not constitute a waiver of such right or provision.
Severability
If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, or unenforceable for any reason, such provision will be eliminated or limited to its minimal enforceable extent, while all remaining provisions of the Terms and Conditions will continue in full force and effect.
Choice of Law
Any disputes hereunder will be adjudicated under the laws of the State of California, U.S.A. and Participants agree to submit to the jurisdiction of the courts in Orange County, California and specifically waive any rights to any other jurisdiction or venue. The prevailing party will be awarded attorney’s fees.
