Eligibility

BenQ America Corp. MOBIUZ Giveaway (hereinafter the “Giveaway”) is OPEN ONLY TO LEGAL U.S. RESIDENTS OF THE UNITED STATES 18 YEARS OF AGE AND OLDER who are physically located and residing therein and who are eighteen (18) years of age or older at the time of the giveaway entry.

Employees or the immediate family of employees of BenQ America Corp. or any distributor, representative, agent or affiliate of BenQ America Corp. (Collectively, the "Giveaway Entities") and their immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters, regardless of where they reside) are ineligible to participate in this giveaway. No purchase is necessary to win. The Giveaway is void where prohibited by law and is subject to all Federal, State and Local laws.

How to Enter

To enter the Giveaway, during the Giveaway Period as defined below, interested individuals will visit [INSERT LANDING PAGE], enter their name, email address, and answer the gaming question. Completion of and receipt of an entry is the sole responsibility of the participant. BenQ America Corp., its employees or agents will not acknowledge or respond to any inquiries regarding the receipt of or status of any entry. BenQ America Corp. reserves the right, at its sole discretion, to cancel or terminate the Giveaway in whole or in part at any time should any unforeseen occurrence cause the fair and impartial continuation of the Giveaway to be impossible. By completing the act of entry, each participant agrees to abide by the Official Giveaway Rules herein stated. Only one entry per email address. Duplicate or multiple entries will automatically disqualify an Entrant.

Giveaway Period

he giveaway period begins at 12:00 pm EST on September 1, 2020 and ends at 5 pm EST on September 30, 2020.

Prizes

Grand Prize: Three (3) BenQ America Corp EX2510 Monitors will be awarded to three separate winners in a random drawing from all submissions. The Grand Prize consists of three monitors valued at $249.99 each. Approximate Grand Prize total value: $750.

Prize Drawing

Grand Prize will be randomly drawn on October 1, 2020 at 2pm, EST from all eligible entries received during the Giveaway period. Winners will be notified by phone or email on or before October 8, 2020. In order to claim the prize, the potential winner will be required, at BenQ America Corp.’s sole discretion, to submit a copy of valid identification card and to complete an affidavit or declaration of eligibility and/or liability and publicity release which must be signed and returned to BenQ America Corp. or its agent within seven (7) days of the date of notification or a new, randomly selected winner will be chosen. Prize is nontransferable.

All Federal, State and Local taxes, fees and other expenses not specified herein are the responsibility of the Prize Winner. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners acknowledge that the Sponsor and all other businesses affiliated with this Giveaway and their agents do not make, nor are in any manner responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions, fitness or merchantability of any aspect of the prize being offered, except that each merchandise prize shall be subject to its manufacturer’s standard warranty (if any). Once the prize has been delivered to the winner’s provided address, the prize is considered awarded. . If the BenQ prize product is not available at the time of the award, an equivalent or better product will be awarded in its place.

If a potential Winner either declines a Prize, cannot be contacted within seven (7) calendar days of the random drawing or is deemed ineligible to accept the Prize, an alternate Winner may be chosen at the discretion of the BenQ America Corp.. There is a limit of one (1) grand prize per winner. Odds of winning will depend upon the total number of eligible entries received. In case of a dispute, the decision of BenQ America Corp. is final. Allow 4-6 weeks after verification of winner status for the receipt of prize by courier.

Limitation on Liability

Participants assume all risk of loss, damage, destruction, delay or misdirection of materials submitted to Sponsor. Participant agrees to full Official Rules and to decisions of Sponsor, or their designated agent, which are final and legally binding in all respects and further agree that the all prizes are awarded upon the condition that Sponsor, its agents and assigns shall be held harmless, and not responsible for any injuries, losses or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any prizes, or participation in this promotion or participation in or travel to any promotion-related activities and further acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CIVIL LAW. SHOULD AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 

NON CAPTURE OF ENTRY

TIn the event that for any reason whatsoever an Entrant’s entry, or any portion thereof, is not captured in accordance with these Official Rules, whether through no fault of Entrant or otherwise, including but not limited to as a result of the effects of hackers or the failure of any electronic equipment, or human intervention, computer or cellular transmission, or network connections, any such attempted entry submissions will become null and void and Sponsor shall have no duty to advise Entrant, to allow Entrant to resubmit, or any liability for such failure in any respect; all of which Entrant hereby waives to the fullest extent permitted by applicable law. Specifically without limiting the generality of the foregoing, in addition Sponsor is not responsible for any lost, late, illegal, intercepted, incomplete, misdirected, damaged, destroyed, mutilated, unintelligible or not received entries, or for errors, omissions, interruptions, deletions, defects, delays in operations, in transmissions of entries. If an Entrant does not follow the stated entry method instructions above his or her entry will be viewed as not captured. All entries that are not captured for any reason whatsoever will be disqualified from the Giveaway.

MEANS OF ENTRY AND TAMPERING

Under no circumstances will Sponsor be responsible for awarding more than the stated number prizes herein. An entry obtained outside of an authorized, legitimate channel of method of entry as described in these Official Rules will be disqualified from Giveaway. Entrants are not permitted to use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Giveaway. If it is suspected or discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by Sponsor ) that any person has attempted, or has used any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Giveaway; then he or she may be disqualified from the Giveaway in the sole and absolute discretion of the Sponsor. The use of automated software or unauthorized computer programs to register for Sponsor’s Giveaway is prohibited. Sponsor reserves the right to disqualify any person found or suspected of, tampering with the entry process, or the operation of this Giveaway, or interferes with the proper entry of this Giveaway, or is acting in violation of these Official Rules, or is acting in an unsportsmanlike or disruptive manner, or is acting with intent to annoy, abuse, threaten, or harass any other persons will be disqualified. WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE THIS GIVEAWAY OR INTERFERE WITH THE OPERATION OF THE GIVEAWAY, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. If for any reason this giveaway is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the giveaway or any element thereof and Sponsor may conduct a random drawing to award the prize using all eligible, non-suspect entries received as of the date of action requiring such termination.

Release

RELEASES. By entering this s Giveaway, each Entrant agrees, without limitation, to release and hold harmless BenQ America Corp. and its affiliates, licensees, franchisees, subsidiaries, advertising and promotion agencies, from any and all liability for any injuries, loss or damage of any kind in connection with this Giveaway or acceptance and use of a prize won. By acceptance of a prize, winner further agrees to BenQ’s use of his/her name, photo and/or likeness for the purposes of advertising, trade or promotion without further compensation (Tennessee residents excepted), unless prohibited by law.

Governing Law

BY ENTERING THE GIVEAWAY, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (C) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED TEN DOLLARS ($10.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (D) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. 

By completing the act of entering the giveaway, each Entrant agrees that the giveaway shall be governed by the laws of the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Giveaway Rules shall be governed and constructed in accordance with the laws of the State of California.
